The man charged in the 2007 homicide of Jennifer Bennett was back in court on Friday.

Craig Ingersoll's appearance was part of a continuation to a Huntley Hearing that first took place on September 6th.

The defense called Deputy William Cole to the stand, who is an employee of the Oneida County Jail.

Ingersoll's attorney, Assistant Public Defender, Luke Nebush says they requested Mr. Cole to testify because he was the one to transport Ingersoll from the Oneida County Jail to the law enforcement building.

"Through an investigation, it was to our belief that a conversation took place. However, he did not remember transporting Mr. Ingersoll, and did not remember any conversation taking place," said Nebush.

Mr. Nebush says he believes there was a conversation and that there was a mention of an attorney.

Now, it's up to the judge to decide if the statements made during the investigation can be used at trial.

The trial is scheduled to begin November 5th.
