Andre Jackson has been charged with criminal possession of a weapon in the second degree.
Opening statements got underway today in Oneida County Court.
It was back in May of 2011 when police responded to a shots fired call.
That's where they found a man had been killed.
During that investigation, Mr. Jackson was discovered underneath a car and the next morning, a handgun was found near where Jackson was discovered.
Prosecutors say that a trace of DNA on material attached to the gun is linked to Mr. Jackson.
Jackson's attorney, Les Lewis says no one can prove his client actually possessed the gun.
Several UPD Officers testified during Tuesday's trial, and Mr. Lewis says he expects a verdict to be made sometime on Wednesday.
