Stabbing Victim's Brother Testifies in Felony Hearing

A Brooklyn man who is accused of stabbing and killing 20-year-old Stephen LaPointe of Rome was back in court for a felony hearing.

The victim's brother testified in front of family and friends as he recalls what happened the night of September 27^th.

19-year-old Sheldon Brown was there the night his brother Stephen LaPointe was stabbed. Sheldon says he remembers walking down on Lawrence Street that night headed to the canal in the City of Rome with his brother and three other girls.

They crossed paths with a guy on a bike and words were exchanged.

Sheldon says he remembers the guy on the bike, in his words, "poking" his brother repeatedly.

26-year-old Terrence Dames was later charged with second degree murder. Two police officials involved in the case also testified during the hearing.

Officer Fred Carnevale says he later spotted Dames, who fit the description of the stabber.

After giving a fake name and different dates of births, Carnevale arrested Dames.

Dames was taken in for questioning and reports show he gave two different stories, one before Stephen's death and one after.

The victim's brother says he doesn't believe Dames.      

"To be honest everyone has their own story. But if you give one story before my brother passed and another afterwards...You sound pretty fricken guilty. How do you change your story from 3 hours ago? One minute my brother is a box cutter and the next minute you stab my brother with a shank" explained Nicholas LaPointe.

"It's for my brother. It's his name...The date he was born. The date he died. It says I love you bro...See you soon," said Nicholas as he shows off his new tattoo on his left forearm.

Nicholas wants people to know his brother was a good man getting his life back together.

"He said he was going back to school. He was getting his life straight. He was the person who got out jail and fixed his life not the person you know who gets out of jail and goes straight back to jail. He was going back to college. We got the paper work yesterday for his financial aid. He was waiting until he was 21 so didn't have a burden on my parents" said Nicholas.

Dames pleaded not guilty and his case will be brought before a grand jury. Funeral arrangements for Stephen will be held over the weekend.
