The Retired State Trooper, Anthony Randazzo who shot and killed "Shadow," The German Shepard in August was back in court Monday morning.

Randazzo rejected the plea deal offered.

He is facing charges of aggravated assault, which is a felony, as well as a misdemeanor charge of overdriving, torturing, and injuring animals.

Randazzo shot and killed the German Shepard at The Greenbelt Trails on August 24th.

Shadow's owner, Bernard Sperfeld says it was because of an argument he had with a woman the night before his dog died.

The woman that Mr. Sperfeld came in contact with was in Randazzo's car at the time he shot Shadow.

"My client maintains that the dog was charging down the hill at him. He happened to have a pistol which he had a license to be carrying. This is about whether or not Mr. Randazzo was justified in his fear that he was endangered when the dog came charging down the hill. Forget mystery woman, forget all of that," said Randazzo's attorney, Les Lewis.

Lewis says he has requested a motion to dismiss charges for his client.

Randazzo will be back in court on December 7th.
