Blainey charged with murder and rape in death of Davis Motel owner

The serial rapist and one time fugitive Robert Blainey has now been charged with raping and murdering Linda Turner in early November.  Blainey is facing 6 charges.  Those include murder in the first degree, rape, burglary, robbery, grand larceny, and criminal trespassing. 

Police believe Blainey hid in a room at the Davis Motel in North Utica for a few days before raping and killing Turner, the owner of the motel.  They also believe he stole some of Turner's money before taking her car.  Blainey pled not guilty in court today and the prosecution offered no plea bargain.

"Mr. Blainey should never walk free. That's my position," said McNamara, "Based upon the fact that we can ask for that punishment we are asking for life without parole."

Blainey's attorney Leland McCormac says his client has been agreeable throughout the process so far, and understands the gravity of the case. "Certainly it's a very, very, very serious matter," said McCormac, "And I think he realizes the import of it."

McNamara says he thinks the defense could explore the possibility of a psychiatric defense.  "They would have to show that he was suffering from some kind of mental disease or defect that made it so he didn't understand the nature and consequences of his actions or that what he was doing was wrong. Obviously we would fight any sort of psychiatric defense," said McNamara.

In response to asking about the possibility of that defense, McCormac responded, "Certainly your client's mental state is of paramount concern.   Just based on the allegations themselves it's certainly an issue that I will fully explore."

Blainey is set to appear in court January 18^th.
