State Corrections Officer accepts plea offer

A state corrections officer who was found not guilty on two felony assault charges in June was back in Oneida County Court on Monday.

During the trial of Michael Wehby in June, the jury wasn't able to reach a verdict on a misdemeanor assault charge that was left over.

On Monday, the defense and prosecution were able to work out a disposition.

Wehby plead guilty to official misconduct, which is a misdemeanor.

The prosecutor in the case says part of the plea agreement would be that Wehby would have to retire from his position.

"Despite the fact that we believed that at trial we would prevail, we couldn't take the risk that if the event that he was convicted, he would then not be able to retire," said Wehby's attorney. Michael Daley.
