Blainey Coverage: Unanswered Questions

Many community members have questions as to why serial rapist and now accused murderer Robert Blainey was out behind bars to begin with.

Peter Cutler, the Director of Public Information for the New York State Corrections Department, says Blainey was abiding by all the regulations and rules imposed on him behind bars.

He was given multiple chances to set a conditional release date to be released on parole. But, according to parole hearing documents, Blainey refused.

Blainey told parole commissioners "I will refuse the conditional release date at all costs." The parole commissioner then asked what his reasoning was. Then Blainey responded... "Society is safer with me in prison...In your eyes I am a low-life rapist which is true and I am not going anywhere."

But in 2009, he changed his mind and signed the conditional release papers. Otherwise he could have been behind bars until 2019, his maximum sentence.

But, Assemblyman Brindisi says in Blainey's case... The state of New York needs to impose stricter laws regarding repeated sex offenders.

"Requiring these serial offenders to wear global tracking devices so they can be better tracked by law enforcement... In this case where you have Robert Blainey who raped an 8 year old girl and two women.. He lost his rights when he did that.. We have to make his life a little harder and the laws a bit better," says Brindisi.

Mr. Brindisi says over twenty states have passed legislation calling for better monitoring of repeated sex offenders.

Mr. Brindisi says there was a bill in the assembly last year to introduce GPS ankle bracelets the offenders would wear. But, it did not go through.
