Utica Man Suing Police Department

    A Utica man is suing the Utica Police Department after he was arrested for assault back in January of last year.  Former restaurant owner MattCuda has filed a civil lawsuit saying police maliciouslycharged him with beating his mother... Something he says he never did. The case never went before a grand jury. The district attorney's office says there was insufficient evidenceto support the charge. The lawsuit accuses the Utica Police Department of false imprisonment, assault, and battery.

            Cuda's attorney Mark Wolber says, "In my years of handling criminal cases, I don't recall ever seeing any criminal charges filed against someone, particularly on a felony level where there has been no supporting deposition from someone to verify the allegations that were made against the individual."

            Cuda is seeking financial compensation in the lawsuit.
